We also represent clients in administrative dispute resolution and administrative disputes. Over the years, our dispute resolution team has gained a wealth of experience in handling complex commercial disputes, especially those involving real estate, mining and natural resources companies.

FRANS ASIDO TOBING & PARTNERS would accompany client in the Criminal Defense and Criminal Investigation at the Police Station (Polres, Polda, Bareskrim Mabes Polri), Prosecutor and also in any jurisdiction of Indonesia Criminal Court.

We can assist Client in General Mining, Mining Construction, Mining Contractor, Mergers and Acquisition on Mining Companies, Legal Due Diligence and Commercial Dispute Resolution on Mining Company.
General Corporate and Non Litigations
Covering legal services relating to legal advices on the activities of the business / corporate starting from the legality of the establishment including the operation, cooperation agreements, establishment of foreign capital investment companies (PMA) with licenses as required by the Client.
Starting from the early stage of the company formation, organize the standard operation procedures for Board of Directors’ meetings, communications with shareholders of companies, shareholders’ meeting, merger and acquisitions, buy back of shares transactions, strategic investments and joint ventures.
Industrial Relation & Employment Law
We have a team of lawyers who have extensive knowledge and experience in handling all types of labor issues in the context of business transactions and daily operations. We can assists Client in the private labor market in drafting and interpreting Employment Contracts, preparing Working Agreements; Company Regulations; severance matters, pension funds, outsourcing arrangements, mandatory training and social security programs, as well as in settling complicated employment dispute.
Bankruptcy and Suspension of Payment
Our office can act to represent Client both as a creditor to file the bankruptcy petition or to represent and defend Client as Debtor or bankruptcy appelle. Where we also have an Advocate which listed as Receiver and Administrator in the Ministry of Justice of the Republic of Indonesia with duty to settle all the property in bankruptcy.
Legal Audit
Legal issue would be very troublesome for client. It required an examination of the risks of existing laws against the client transaction activity or investment which to be carried out or that has been implemented by the Client. In order to minimize the risks, our office can provide legal audit services by certified legal auditor against Client transaction plan or client transaction activity, and legal issue so it can be known for certain legal risks that may arise in the future.
LEGAL CONSULTATION FOR IN-HOUSE LAWYER/COMPANY
Our office also provides legal consultation for in-house lawyer or company towards multinational as well as national (domestic) company concerning any legal matters faced in business undertaking.
These legal service are divided into 2 (two) categories, as follows:
- Legal Service to Retainer Clients.
We continuously provides legal consultation for in-house lawyer or company based on requesting basis. The Consultation can be conducted in our office or client offices. For this service, the cost and other costs arise up should be borne to client, in which the billing statement is settled on regular bases e.i monthly or other time agreed.
- Legal Services on Consultation Basis
We provides legal consultancy for in-house lawyer or company on requesting basis. For this legal service, the cost and other costs arise up should be borne by client and the payment is settled per consultation basis.
Intelectual Property Rights
Our office has Advocate registered as a IPR Consultant at the Ministry of Justice and Human Rights, and therefore can provide extensive services in the field of Intellectual Property Rights (IPR), including but not limited to the process of search and registration of intellectual property rights (Trademark Patents, Copyright and Industrial Design), the transfer of intellectual property rights, opposition and appeal efforts in the process of registration and issuance of Certificate of Haki in the Directorate General of Intellectual Property Rights; as well as representing the interests of clients when there is a dispute against the ownership of Intellectual Property in the Commercial Court until to the Supreme Court.
